Terms of Use & End User Licence

Please read these terms before playing. They are written to be clear, and they include the minimum terms Apple requires for apps distributed through the App Store.

1. Agreement

These Terms of Use and End User Licence Agreement (the “Terms”) form an agreement between you and AI Ethereals (“we”, “us”, “our”), the developer and publisher of the Dracore game for iOS and its related website and online services (together, “Dracore”). By downloading, installing or using Dracore you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Dracore.

2. Eligibility

Dracore is not directed at children under 13. You must be at least 13 years old (or the minimum age required in your country) to use Dracore. If you are under the age of majority where you live, you may use Dracore only with the involvement and consent of a parent or guardian, who agrees to these Terms on your behalf.

3. Your licence

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use Dracore on Apple-branded devices that you own or control, for your personal, non-commercial entertainment, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

You may not, and may not help anyone else to: copy, modify, distribute, sell, rent, lease or sublicense Dracore; reverse engineer, decompile or disassemble it, or attempt to derive its source code (except where the law expressly permits this despite this restriction); remove proprietary notices; or use Dracore to build a competing product.

4. Apple App Store terms

If you obtained Dracore through Apple’s App Store or TestFlight, the following also apply:

  • Parties. These Terms are between you and AI Ethereals only, not Apple Inc. (“Apple”). We, not Apple, are solely responsible for Dracore and its content.
  • Scope of licence. The licence granted to you is limited to use on Apple-branded products you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Dracore may be accessed by other accounts associated with you via Family Sharing or volume purchasing where available.
  • Maintenance and support. We are solely responsible for providing any maintenance and support for Dracore. Apple has no obligation to furnish any maintenance or support services.
  • Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Dracore fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for Dracore to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Dracore.
  • Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to Dracore or your possession and use of it, including product liability claims, claims that Dracore fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
  • Intellectual property claims. If a third party claims that Dracore or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
  • Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Developer contact. Questions, complaints or claims about Dracore should be directed to AI Ethereals at support@dracore.app.
  • Third-party terms. You must comply with applicable third-party terms of agreement when using Dracore (for example, your wireless data service agreement).
  • Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Where these Terms conflict with the Apple Media Services Terms and Conditions regarding your use of Dracore obtained from the App Store, Apple’s terms take precedence to the extent of the conflict.

5. Beta software

Dracore is currently offered as a pre-release beta through Apple TestFlight. Beta versions may contain bugs, may change or remove features, and may reset or lose progress. Beta builds expire under TestFlight’s rules. Please do not rely on beta builds for anything important, and keep any beta details we ask you to keep confidential. Your use of TestFlight is also governed by Apple’s TestFlight terms.

6. Online features & anonymous accounts

Online duels (quick match or room code) and Cloud Backup are optional. Cloud Backup is off by default and can be turned on in Settings → Online. Using an online feature creates an anonymous account consisting of a random ID and a secret token stored in your device’s Keychain. You are responsible for activity that takes place through your device’s account. Online features require an internet connection, may be interrupted for maintenance, and may be changed or discontinued. Nearby duels connect two devices directly over Bluetooth or peer-to-peer Wi-Fi, without our server.

7. Acceptable use & online conduct

Dracore is meant to be fun and fair for everyone. When you use Dracore, you agree not to:

  • choose a warden name, or otherwise communicate anything, that is offensive, hateful, harassing, sexually explicit, threatening, impersonates another person, or contains personal information (yours or anyone else’s);
  • cheat, exploit bugs, manipulate duel results, or use bots, modified clients, automation or any unauthorised third-party software;
  • tamper with, intercept, reverse engineer or interfere with the Dracore server, relay or network traffic, or attempt to access another player’s account, token or data;
  • overload the service, circumvent rate limits or security measures, or probe for vulnerabilities (please report security issues to support@dracore.app instead);
  • deliberately disconnect or stall to deny an opponent a fair result;
  • sell, trade or transfer accounts, saves or in-game items for real money or outside the game;
  • use Dracore for any unlawful purpose or in violation of these Terms.

We may rename offensive warden names, void results, reset affected progress on our server, or restrict online access to enforce these rules.

8. Virtual items & progress

Dragons, eggs, coins, resources, food, toys, equipment, battle spoils and other in-game content (“virtual items”) have no monetary value and cannot be redeemed for real money or anything of value. You receive a licence to use virtual items within Dracore only; you do not own them. Progress is stored on your device, and optionally in Cloud Backup. We are not responsible for progress lost because the app was deleted, a device was lost or reset, or backups were not turned on, except where the law says otherwise.

9. Purchases & refunds

Dracore currently has no in-app purchases or payments. If purchases are offered in future, they will be processed by Apple through the App Store under Apple’s terms, and refunds must be requested from Apple. 10. Intellectual property

Dracore, including its code, dragons, characters, names (such as Stormclaw, Emberfang, Briarhorn, Stoneback and Dawncrest), artwork, models, animation, music, sound, text, logos and the “Dracore” name and crest, is owned by or licensed to AI Ethereals and protected by intellectual property laws. Except for the limited licence above, no rights are granted to you. You may share personal, non-commercial screenshots and videos of your gameplay, provided you do not imply our endorsement.

11. Feedback

If you send us ideas, suggestions or beta feedback, you allow us to use them freely without obligation or compensation to you.

12. Augmented reality safety

AR features, including the egg hunt and AR Explore mode (following footprints to hidden finds), ask you to move around while looking at your screen. Always stay aware of your surroundings. Play only in safe, open, private spaces; do not use AR while walking near roads, stairs, water or other hazards, while driving, or where you might trespass or disturb others. Children should use AR features only under adult supervision. Take breaks, and stop playing if you feel unwell.

13. Suspension & termination

You may stop using Dracore at any time by deleting your online data and the app. We may suspend or end your access to online features if you seriously or repeatedly breach these Terms, or if required by law. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability and governing law) will survive.

14. Disclaimers

To the maximum extent permitted by law, Dracore is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that Dracore will be uninterrupted, error-free or free of harmful components, or that online features or backups will always be available. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be excluded — including, where applicable, guarantees under the Australian Consumer Law, and statutory rights in the UK and EU.

15. Limitation of liability

To the maximum extent permitted by law, AI Ethereals will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress, profits or goodwill, arising from or relating to your use of Dracore. Our total liability for any claim relating to Dracore is limited to the greater of the amount you paid for Dracore (if any) in the 12 months before the claim, or USD $50. Some jurisdictions do not allow these limitations, so they may not apply to you. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

16. Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which AI Ethereals is established, without regard to conflict-of-laws rules. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and you may bring proceedings in your local courts. Before starting any formal dispute, please contact us at support@dracore.app so we can try to resolve it informally.

17. Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date above and, for material changes, provide notice in the app or on this website. If you continue to use Dracore after changes take effect, you accept the updated Terms.
